Taberna Master Homeowners Association Meeting Minutes:  December 11, 2007

Meeting was called to order at 5:30 PM by President Bob Constanzo.

Minutes to be taken by Alva Windham, Acting Secretary.

 

Motion was made by Bernadette McNulty to accept the minutes of November 6, 2007, THOA meeting as submitted.  Motion seconded by Suzanne Forsythe.  Motion unanimously approved.

 

No Agenda was distributed.

 

TREASURER’s REPORT:

Total cash available as of 12/10/07 in the operating checking accounts for Master and Sub-Assns. totaled $79,315.  Total accounts receivable outstanding at 11/30/07 was $5,055.

 

Per the Board’s authorization in November, all Reserve deposits were made according to the 2007 Budget except for Abbington Woods.  The Treasurer reported that due to the remaining accounts receivable outstanding from a multiple property owner in Abbington, there was insufficient funds for a full transfer.  She will transfer funds as they come available.

 

The number of liens outstanding remains at seven.  Invoices for seventeen late fees were sent out as of the first of December. 

 

DEC. 17, 2007, ANNUAL MEETING PREPARATIONS:

The Board members were able to gather an additional 48 proxies, bringing the total number of proxies to over 160.  It was noted that a few people who had signed proxies may attend the meeting, but it is expected to have sufficient attendance and proxies to make a quorum.

 

It was requested that the volunteers and Board members arrive at the meeting no later than 6:15PM.  The meeting will be tape recorded.   All paperwork to be distributed to the attendees, including the agenda, financial information, and last year’s minutes will be placed on the sign-in tables in the lobby.  All Committee chairmen will be requested to speak at the meeting if they choose to do so.

 

All questions that had been e-mailed to the Board earlier have been answered and will not be brought up at the meeting.  The Board discussed several other possible questions that may be raised from the attendees of the meeting, and the appropriate response to each.  These may

include questions about such topics as dues increases, beautification project selection and costs, the Super 70 Corridor, maintenance of community and private property, and Taberna Townes.  No matter what questions arise in the meeting, the Board recognized the need to provide accurate responses specifically for the questions asked.

 

VIOLATIONS:

Nothing to report.

 

MISCELLANEOUS BUSINESS:

 

WATER / SEWER PERMIT:  The President announced that the THOA has received the water/sewer permit from the State of North Carolina.  Although the City of New Bern is responsible for normal drainage throughout the community, the THOA is now responsible for drainage and flood waters, etc. around the wetlands area.  Failure to do so may result in fines to the THOA from the State.  The President will check with our attorney to obtain a better idea of what we are actually responsible for under this permit.  It was decided that the Architectural Committee should be assigned to oversee the maintenance and adherence requirements of this permit.

 

FILM PRODUCTION REQUEST:

Suzanne Forsythe was contacted by the production supervisor of the feature film that is to be filmed in Taberna for permission to film at the canoe docks over a period of two days.  Permission had been granted at a prior THOA meeting to film interior shots for the film, Death by Chocolate, at the Taberna residence of the film writer and producer. That approval was given with the understanding that no exterior shots would be done.   In this request, no property owners property would be included in the film, filming would occur in the daytime hours, and that the filming company has insurance to cover any damage that may occur.   In discussion, Bob Costanzo brought up the fact that this is a business venture and the film company should not have the right to utilize the Common property per our Covenants and By-Laws.  In further discussion, the members were reminded that past Board’s have strictly enforced guidelines regarding the usage of Common property by non-Taberna residents.  With that in mind, a motion was made by Terry Smith:  “The filming company should not be allowed to do any filming within the Homeowners’ Association responsible area to include the common areas.  This does not include any filming within the resident’s home.”  Motion was seconded by Alva Windham.  Motion approved.
